Workmans Comp Lawyer

Filed under: Lawyers' Net @ 12:04 pm

When I was injured on the job, my workmans comp lawyer was a godsend. Now this wasn’t one of those really dramatic injuries that you might see in a workmans compensation attorney advertisement on tv. I wasn’t hit by anything falling, cut by anything sharp, run over by anything heavy. And yet, according to my workmans comp lawyer, the type of injury I did suffer was more common than all of those combined. You see, I received what is known as a repeated stress injury, and it ruined months of my life.

I work as a factory - an auto factory to be precise. It is my responsibility on the line to turn, grab the fender, and lower it into place on a car body passing by. It is heavy work, but not quite as hard as you might think because it is all hydraulically assisted, but still, it does put strain on the body. Repeatedly twisting to the right and the center all day, five days a week, twelve months a year, puts a strain on the body that it wasn’t really meant to handle. But when I started complaining of back troubles they refused to transfer me to another place on the line, even though I could easily be taught to do a different motion in the assembly line.

Finally, after months of complaining to deaf ears, I threw my back out. I was laid up for six weeks, in terrible pain and scarcely able to walk. When I called my workmans comp lawyer, he told me that I had a very solid case. I had hired a very good workmans comp lawyer on the suggestion of my cousin, who had also been injured on the job, and he told me that it was a near certainty that we would win.

When the workmans comp lawyer contacted the company, they stonewalled only briefly. It was no long at all until they were gung ho to settle out of court. The package that they were offering was more generous than I would have expected, but they had ruined my health. I wanted to go for broke. My workmans comp lawyer pursued the case and won 800,000 dollars for me, to take into account both injuries suffered and pain and suffering. In addition, they are required to allow me to remain employed, on disability, for the next six months, and then offer me a position. I certainly didn’t do wrong to hire a workmans comp lawyer.

Things to Watch Out For When Choosing an Attorney

When you need an attorney, it’s always a good idea to do some searching until you find one who makes you feel confident and comfortable. You can search for attorneys by asking for referrals from people whom you know well. You can also do your search on the Internet, where detailed information about an attorney or a law firms is often available. When you have found a few prospects, you can interview them to get to known them better. You can ask each attorney for some references from their previous clients.

During your attorney search, there are some things you should always watch out for.

First of all, you want to stay away from frauds. Believe it or not, there are people posing as actual lawyers, making money by collecting money from clients. Before making a deal or paying any fee, you should make sure that you know enough about that attorney. Verifying the authenticity of the attorney is always necessary.

Secondly, watch out for high chargers. Some attorneys charge their clients a very high fee for their services. They turn their client’s simple cases into very complicated ones and thus charge them a much higher fee. To avoid this, do some research to get some ideas about what a fair price should be for your case. To do this, you can ask people with similar cases how much they have paid their lawyers. Also, you can shop around and compare prices from different lawyers before you choosing one.

Another pitfall you should try to avoid is inexperienced attorneys. In most cases, it requires an attorney to have enough experience in the specific field in order to help you. In order to find experienced attorney and avoid inexperienced ones, you should spend some time to check the attorney’s background and previous experiences. This kind of information is often easily obtainable. Also, you can ask other people for their opinions on an attorney.

When searching for an attorney on the Internet, you should also be cautious about hackers. Hackers might set up a fake attorney website and trick you to go to their sites and enter your personal information. In addition, when entering a hacker’s site, your computer might be attacked by virus or spyware, which might damage your computer’s operating system. In order to avoid this pitfall, make sure you have anti-virus and anti-spyware software installed on your computer system and do not click on suspicious links from unauthorized sites or junk emails.

A mild Mannered Mixture

Typically found in bottles wine can have some outlandish effects on people if drank in too larger quantities, as found out by jesus, my friend and other people.  But lets not split hairs, I like wine. But thats not what this post is about, today I am writing mainly to discuss the fermentation of grapes into a drink but also my new collectables blog, designed in essence to provide people searching for rare or unusual collectables with a place to find all that they are looking for.

My favourite topic to guest write about is motoring. I live in west wales and recently when searching for a second home I came across a car dealer ceredigion, which provided me with the coolest of cool cars. 3 Wheels and a tin bonnet thinner than ham, seriously cool - and red too!!

Divorce Records

Filed under: Security Infos, Misc Infos, Lawyers' Net @ 1:19 pm

A divorce record search is important in many ways.  The search will reveal comprehensive information such as.

  • Is the divorce legal?
  • Names of the parties to the divorce
  • Where the divorce was made
  • When the divorce took place

In addition to this basic information, a divorce records search will also disclose if there were restraining orders involved and even if there was a citing of domestic violence.  Other pieces of information that can be had are child custody status, settlement details and property disbursement.

Divorce records are typically made available in each individual county and are also stored with each state.  Many states house all records in one location but there are still several states that leave it up to the county government to store and make divorce records available.  When making a request it generally takes a week or two to get your record search.  The internet has dramatically improved this process and cut down the response time from weeks to seconds.

Good luck!

Are you Caught up in an Accident?

Filed under: Lawyers' Net @ 6:06 am

In the case of an automobile accident, and if somebody is
injured, you should do everything you can to help especially if
there are no medics at that moment. If you have knowledge in
first aid, it would be better so that you can help relieve the
pain of the suffering individual. If you want to help the
victim, there will be certain measures that you need to follow.

When you are in an accident spot, do not try to move an injured
person in his position because there might be some broken bones
that may cause the patient too much pain that might worsen his
condition. If there are people around, ask them to call the
police and inform them that some people are injured. It is also
helpful to inform the police officer as to how many persons were
injured. This is important so that the emergency personnel will
be able to prepare the things and materials needed for them to
respond to the scene. If you are in the roadway, you can turn
your flashers on and you can use flares to warn the forthcoming
traffic.

If there are no police officers yet, you can obtain some
important information that will be helpful to patch up the
findings of the accident. Some of the important information you
need to gather are the following:

- The name of the driver and the other driver, which include
complete name, address, insurance information, license number
and the number on the license plate. This is important so that
if the person has been to a very serious injury to the extent
that his face is unidentified, the license number will be a good
source of information. - Getting the names of the witnesses in
the scene is also important. You can get their complete name,
address and the phone number. This is important because if the
case is in the court, they will be able to testify about what
really happened in the accident. This will also be helpful to
find out who is at fault.

- Get the information of the officers who investigated the
traffic scene. You can ask for a business card, which has all
the important information. However, if you do not ask for it,
the police officers will instantly give you the information. -
The last is taking note of the exact location to which the
accident happened so that if there will be investigating
procedures, the team can investigate accordingly.

Patents: A Tool for Technological Intelligence

Filed under: Lawyers' Net @ 3:44 pm

Patents are the largest source of technological information. Patent are given to the inventor as a reward for its innovation in the form of the exclusive right of the monopoly for a period of 20 years from the priority date of the invention. Due to advancement in the IT sector and internet, now these valuable documents are in the reach of the general public. Any person skilled in the art can go through various patent databases and after a search can get the patent document of their need. There are different patent databases viz, USPTO, EPO, JPO, etc freely open for the public access. If we go through the patents related to a specific technological area, we will be able to find the lots of information about the life cycle of the technological innovation viz.,

• evolutionary path of a specific technology,
• technological development,
• technological diversification,
• technology merges,
• major players in specific technological area,
• key points of the specific technology,

“The World Intellectual Property Organisation (WIPO) revealed that 90% to 95% of all the world’s inventions can be found in patented documents.”

Patent analysis can reveals very valuable informations, which is not available anywhere. After patent search the crucial part is the patent analysis, and one have to be very concise about their objective of the study. The information in the patent documents can be utilized in different form according to the need and mapped accordingly to get the picture of the entire analysis in snapshots.

Patent data can be used for the preparation of technological landscapes. Logistic mathematics and circle mathematics can be very useful in the plotting of the technological landscape. It can reveal the evolutionary trend of a technology, how it is evolved from a basic technology, along with the period of the technological diversification and its nature. These maps will also give the detailed overview of the merging of the different technologies to give rise to break-through technologies. These types of maps will be very useful for the R&D personals to evaluate the position of their research and technology, and also they will find way to more innovate more advanced and valuable technology.

In the today’s global context firms need to know what technologies can competitors choke easily, and may be attempting to. They also need to know the spaces in technologies where competition is intense, and the areas where competitors are concentrating their IP development and their R&D efforts. They need to be able to track patent acquisition and development strategies and chart out the competitive landscape. To evaluate technology before making any investment decision, firms need to know the pace of patenting activity in the technology, which patents embody fundamental ideas in the technology and how vulnerable the firm’s technologies are to patent infringements. This will give them much needed information in deciding between technology development and technology acquisition.

The ability to extract relevant information from patent literature is a crucial success factor for anyone involved in technological innovation. The technology mapping technique’s that can be used to transform patent information into knowledge that can influence decision-making.

Patents are an important source of technological intelligence that companies can use to gain strategic advantage. Technology Intelligence is a can be used for gathering, analyzing, forecasting, and managing external technology related information, including patent information. Computational patent mapping is a methodology for the development and application of a technology knowledgebase for technology and competitive intelligence. The primary deliverables of patent mapping is in the form of knowledge visualization through landscape and maps. These maps provide valuable intelligence on technology evolution/revolution, nature of various types of pioneering; big; pure; and emerging players, state-of-the-art assessment, etc.

These types of technological maps will prove to be a valuable multiplier in R&D and commercialization activities, in various ways including the following:

• Developing further insights in response to strategic requirements and policy formulation in the organization

• Forecasting and identifying technological activities and trends in the industry

• Aiding in the visualization of alternative development and growth paths available to the organization

• Enabling pre-emptive recognition and action on potential licensing opportunities

• Identifying prospective partners and clients

• Identify technology discontinuities and areas of opportunities in their chosen technologies

• Monitor and evaluate the technological process of competitors and potential competitors

• Support decisions on foray and investment into particular technologies and sub-technologies

• Surveillance of technological progress of competitors as well as to alert oneself to new entrants to the field

• Spotting of white spaces or opportunity areas within a dense technological domain

• Creative tool to simulate new ideas and create new IP

• Complementing corporate IP filing strategies

• Support technology proposals for large scale national and international level projects

• Support investment and technology due diligence on companies

Patent mapping can be an integral part of IP management. It can uncover valuable information hidden in patents and can provide useful indicators for technical trends, market trends, competitors changes and technological profile and innovation potential of a company. Patent maps are visual representations of patent information that has been mined and aggregated or clustered to highlight specific features. There is a high degree of flexibility in visualization, which may be in the form of time-series or as spatial maps. We provide a more market and technology oriented analysis of the complete set of patent portfolio assets via our patent mapping services. Patent mapping can be used to ascertain the quality of patents with respect to prevailing technology and the extent to which patents affect the technology. This is a valuable input in technology sourcing/development and R&D decisions. Patent mapping can be indispensable for both firms that have an under-utilized patent profile and are looking to license/assign it at the most favorable terms, as well as to firms that are looking at developing patent portfolio strength in a particular technological field.

Mere subject specialization is not enough for this, but analytical thinking and innovations are very essential. Today lots of software resources are available for mapping the patent data, but almost all are confined to bibliographic informations. The machine work cannot be compared with that of human intelligence. Patent mapping requires many skills. First and foremost among these is an ability to understand the complex scientific ideas protected by the patents themselves. Although it is possible to create a patent map by analyzing the relationships between patents without understanding the subject matter, such a map is often useless and needs to be refined by someone who understands the intricacies of the particular scientific discipline that is the basis of the invention. Thus, I expect that the need for people with scientific (and engineering) expertise in the field of patent mapping is on the increase. That’s why today lots of KPO firm are looking for the right individual and there is a huge demand today, which will certainly increase in the near future.
